Switching from Student to Work Permit in Malta

Already in Malta studying? Here is what changes — and what stays the same — when you transition to employment.

Official guidance on this transition is limited

Identità Malta's published guidance focuses on first-time applicants arriving from abroad. The student-to-worker transition sits in a grey area that is not fully documented publicly. The information below reflects the best available interpretation of current rules. Always confirm your specific situation directly with Identità Malta or a licensed immigration adviser.

The core question: is this a "first-time" application?

The key issue for students transitioning to work is whether Identità Malta treats their Single Permit application as a first-time application. This matters because:

  • The mandatory pre-departure course applies to first-time Single Permit applicants.
  • If your application is treated as a first-time application, you will likely need to complete the course — even if you are already in Malta.
  • If Identità Malta recognises your existing in-country presence as a basis for exemption, the course may not apply.

Identità Malta There is no published official exemption for students transitioning to workers. Until formal guidance is published, you should assume the course requirement applies unless Identità Malta tells you otherwise in writing.

What the Single Permit process looks like for you

The process follows the standard Single Permit route, with your employer as the applicant:

  • Step 1: Your employer submits the Single Permit application to Identità Malta with your details and job offer.
  • Step 2: Identità Malta assesses the application (labour market test, documentation, compliance checks).
  • Step 3: If approved in principle, you will be notified of any outstanding requirements — including whether the pre-departure course applies.
  • Step 4: You complete any required steps (course, interview) and the permit is issued.
  • Step 5: You collect your permit card from Identità Malta.

Does the pre-departure course apply?

Identità Malta The pre-departure course became mandatory on 1 March 2026 for first-time Single Permit applicants. The course was designed for applicants who have never held a Malta work permit and are travelling to Malta for the first time for employment.

If you are already in Malta as a student and have never held a Single Permit, your application may still be classified as first-time. The deciding factor is your permit history — not your physical location at the time of application.

Ask Identità Malta directly — and get it in writing

If you believe your situation qualifies for an exemption from the pre-departure course, ask Identità Malta in writing before assuming you are exempt. Verbal confirmations are not reliable. Get any exemption confirmed in an email or official letter before proceeding.

Work rights during the transition

Malta student permits typically specify whether part-time work is permitted. Common scenarios:

  • Student permit with no work authorisation: You cannot work at all until the Single Permit is issued.
  • Student permit with limited work rights: You may be permitted to work part-time within the hours stated on your permit, but only until your Single Permit supersedes it.
  • Expired student permit:If your student permit has expired, you are out of status. Your employer's Single Permit application may still be accepted, but delays are likely and you are at legal risk in the interim.

What your employer needs to do

The Single Permit is always employer-initiated. Your employer must:

  • Submit the application through the Identità Malta employer portal.
  • Provide proof of the job offer, employment contract terms, and salary.
  • Demonstrate compliance with any applicable labour market test requirements.
  • Pay the application fees.

Your being already in Malta does not simplify the employer's obligations — the full Single Permit process applies.
